ROBS "Promoters"  typically do not take on the fiduciary compliance of the plan.  ROBS 401k plans are still governed by ERISA.  They still must following the rules and regulations of a traditional 401k. 

A ROBS 401k plan will need to have prudent investments in the plan along with the employer security, it will need to have a custodian and recordkeeper that understands and services a ROBS 401k plan, it will need an Advisor that can not only manage the traditional investments in the plan but also understands the roll of the Employer Security in the plan.
